在此基础上，笔者对我国法律赋予审判委员会实质意义上的裁判权的规定进行了评析，认为，审判委员会行使裁判权，虽然有其存在的历史原因，但在现在已经是弊大于利，它不利于司法公正，不利于保证案件质量，不利于提高诉讼效率，不利于提高诉讼效益，不利于审判委员会其他职能的正常发挥，不利于提高法官素质，理论界和实务界提出的种种保留审判委员会的裁判权的主张，并不能克服审判委员会行使裁判权的弊端，因此，应当取消审判委员会的裁判权(不是废除审判委员会) ，法定的裁判者只能是负责个案审判的法官和人民陪审员。
